The development of advertising methods on different goods available in the market, led the consumer to acquire them without a second thought about their compatibility with his needs, especially with his weak knowledge compared to a professional.

For this sake, and in order to protect the consumer from the risks of rushing to conclude a consumption contract, most of the legislations related to consumption including the Algerian one recognize the right of the consumer to back out of a contract by his own will without justifying his position.

This right is based on the fact that it is a derogation from the principle of the binding force of the contract, within the framework of what is known as the Public Order of protection, which allowed the legislator to modify the traditional provisions of the general theory of the contract in order to restore the balance between the professional and the consumer in this contract.
