Abstract EN

This study aims at explaining the philosophy of inheritance in Islam in the light of the fair balance between men and women, correcting misconceptions in light of contemporary intellectual trends that call for absolute equality between men and women in accordance with a Western vision of material expression of the Western view that produced it; without taking into account our constants and cultural peculiarities after a long and bitter struggle that Western women have acquired some of their rights.

However, fourteen centuries ago, women in Islam acquired all their rights in the strict legal text derived from the Book of Allah and the Sunnah of His Messenger.

The superiority of men over women in inheritance is not in all cases.

In some cases she is equal to him while in others she may be superior.

Moreover, she may inherit and he might not, due to several considerations, which are overlooked by contemporary intellectual trends.

In this research, the ascetic approach was taken with legalization and analysis.

Among the most important results is the miracle of the Holy Quran in its legislation of inheritance according to a system based on faith, based on achieving social justice among all categories of Islamic and human society.
