يلعب الإلتزام بالإعلام دورا هاما في تحقيق الشفافية على مستوى بورصة الأوراق المالية حيث يساهم في مساعدة المستثمر في إتخاذ قرار الإستثمار من عدمه.
يتم الإلتزام بالإعلام بعدة أساليب و طرق من بينها تقديم المذكرة الإعلامية البيان الإعلامي وتلك التقارير السداسية أو السنوية التي تلتزم بها الشركة المصدرة.
يترتب عن الإخلال بالإلتزام بالإعلام ممارسات غير المشروعة و التي تكيف على أساس أنها جرائم البورصة يخضع مرتكبها لعقوبات جزائية كالحبس و الغرامة المالية و التي تفتقد إلى الطابع الردعي بالنظر إلى خطورة مثل هذه الجرائم
Abstract EN
The disclosure obligation plays an important role in order to guarantee the transparency principle on the stock exchange.
It helps the investor, in other words, the product information, the prospectus, the semi-annual report.
In the event of non-compliance of this disclosure, many illicit practices appear, they are submitted to penal sanctions, which remain insufficient because of the gravity of these offences.
