Abstract AR
تقتضي الظروف الاستثنائية التي يمر بها العالم جراء جائحة كوفيد-19 اتخاذ " تدابير استثنائية " لكي تتمكن الدول من التعامل مع حالات الطوارئ الصحية.
الأمر الذي فرض ضرورة مراجعة التشريعات و الضوابط التي تتيح إمكانية توسيع نطاق الحصول على بعض الأدوية و الإمدادات الطبية الحاصلة على براءات الاختراع انطلاقا من فرض أن الحماية القانونية للحق الإستئثاري للمخترع مؤسسة على فكرة الاحتكار لأجل الربح فمالك براءة الاختراع بإمكانه التحكم في كمية السلع المعروضة في السوق وفي السعر من خلال افتعال ندرة تلك المواد الأمر الذي يتعارض مع متطلبات مواجهة جائحة كوفيد-19 من ضرورة توافر كم هائل من الأدوية و اللقاحات و المنتجات الطبية و الوقائية.
وعليه تم البحث في هذا الموضوع حول مدى ملاءمة نظام الترخيص الإجباري لدواعي المنفعة العامة كحل قانوني لهذا الوضع الإستعجالي و الطارئ وذلك لأن الدستور لم يتوسع في مفهوم و إجراءات حالة الطوارئ في حين أن المشرع وبموجب المادة 49 من الأمر المتعلق ببراءات الاختراع قام بتحديد مضمون حالات الرخصة الإجبارية للمنفعة العامة
Abstract EN
The exceptional circumstances that the world is going through as a result of the Covid 19 pandemic require that "extraordinary measures be taken" in order for countries to deal with the general situation and health emergencies in particular.
This imposed the necessity of reviewing the legislations that allow the expansion of access to some medicines and medical supplies that are patented, because the owner of the patent can control the amount of goods offered in the market And in the price, by fabricating the scarcity of these substances, which contradicts the requirements of confronting the pandemic Covid-19 of the necessity of the availability of a huge amount of medicines, vaccines and medical and preventive products.
This research was conducted on this topic about the appropriateness of the compulsory licensing system for reasons of public benefit as a legal solution to this urgent situation.
