The criminal responsibility one of the most searched in the history philosophy of law, and has developed in several historical phases, this search came for statement of close between the penal legislation Islamic and the Algerian code of criminal about the criminal responsibility, this builds on discrimination and freedom of choice but when the absence of these conditions there is no consequences of responsibility, mainly the barriers of criminal responsibility its; the old, the mental disorder, the coercion, the optional schnapps, case of self-defence, state of necessity, mistake, wrong, and the ignorance, in the investigation of barriers for the criminal responsibility the punishment shall be imposed on its owner complete.
