Abstract EN

During the past few years, the state of Qatar intended to introduce a special legislation for the health insurance which stimulated the attention of people towards it to entail a rise in its balance.

Thereafter it has become a manifestation to one of the economic powers in the state.

Since the health insurance is counted one among the contemporary contracts, the individuals as well as the entities enquire about the level of its Shari’ah compliance.

It is noted that, in general, a smaller number of writings are dedicated to the topic of health insurance, therefore a need is felt to describe its meaning and to separate it out from other types of insurance contracts, similarly, to explain the related rulings therein.

This research study shall discuss the topic by responding to the question: To what level the health insurance contract is Shari’ah compliant as per the jurisprudents and Qatari law? And the subsequent questions.

The questions will be addressed by adopting the descriptive and analytic approaches to assess the views and rulings regarding the health insurance.

Among the crucial results of the research, it is found that all types of health insurance which were the subject of the research are permissible, since the health insurance is aimed at human healthcare wherein the scope of uncertainty is very narrow.
