Abstract EN

Fundamentalist Differences are one of the important studies that are considered as a main part of Usul al-fiqh.

The importance of the study lies in language section used for setting rules and provisions.

Understanding the differences helps to avoid confusion and erroneous slippage.

Differences in Linguistic sections such as differences between taking, constructing and using; some differences are also explanatory for terms and rules such as the difference between copying and customization; and some are a result of the differences between fundamentalists known as scholars’ terminologies and their different connotations such as the perception of text in Hanafi and Jumhoor (the majority of scholars in Maliki, Shafi’i and Hanbali) philosophies.

Similarly, there are terminologies with different utterances but the same connotation.

The study revealed the distinction of the division of Hanafia in connotation which is different from Jumhoor’s perception; that difference lies in Jumhoor’s clarity.
