لقد عرفت العقوبة السالبة للحرية قصيرة المدة انتشارا واسعا منذ ظهورها في نهاية القرن الثامن عشر و اعتبرت من أهم الأساليب العقابية التي ساعدت على التخلص من فكرة العقوبة البدنية القاسية و الهادفة للانتقام من الجاني غير أن الإفراط في تطبيق هذه العقوبة أدى إلى الكشف عن فشلها بالنظر للآثار السلبية المترتبة عن تطبيقها و التي تحول دون تحقيق الإصلاح و التأهيل الاجتماعي للمحبوسين فأصبحت هناك ضرورة ملحة لانتهاج سياسة عقابية جديدة تعتمد على بدائل عقابية مختلفة للحد من مثالب العقوبة السالبة للحرية قصيرة المدة حيث يتم اللجوء إلى هذه البدائل كلما سمحت بذلك ظروف الجريمة و شخصية الجاني و لقد اتجهت التشريعات المقارنة إلى إدراج عقوبات بديلة متعددة و متنوعة للعقوبة السالبة للحرية قصيرة المدة في منظومتها العقابية كما حذا حذوها المشرع الجزائري بتبنيه البعض من هذه البدائل باعتبارها أخر حلقة من حلقات الإصلاح و التأهيل
Abstract EN
The short term's custodial sentence has been widespread since its appearance in the eighteenth century, It was considered one of the most important punitive methods that helped to get rid of the harsh corporal punishment aimed at revenge on the perpetrator, However, the excessive implementation of this sanction led to the detection of its failure, given the negative effects of its application and that prevents achieving social reform and rehabilitation for prisoners، so there was an urgent need to pursue a new punitive policy that relies on various punitive alternatives، where these alternatives are resorted to whenever the circumstances of the crime and the character of the perpetrator.
The comparative legislations have tended to include multiple and varied alternative penalties for the short term's custodial sentence, the algerian legislator also followed suit by adopting some of these alternatives as the last link of reform and rehabilitation.

La peine privative de liberté à court durée a été généralisée depuis son apparition au dix-huitième siècle, elle a été considérée comme l'une des méthodes punitives les plus importantes qui ont aidé à se débarrasser des châtiments corporels sévères visant à venger le coupable, mais la mise en œuvre excessive de cette sanction a conduit à la détection de son échec, étant donné les effets négatifs de son application et qui empêche de réaliser la réforme sociale et la réadaptation des détenus، il était donc urgent de poursuivre une nouvelle politique punitive qui s'appuie sur diverses alternatives punitives.
Les législations comparatives ont eu tendance à inclure des peines alternatives multiples et variée pour la peine privative de liberté à court durée le législateur algérien a également emboîté le pas en adoptant certaines de ces alternatives comme dernier maillon de la réforme et de la réhabilitation.
