On the basis of describing the right of ownership as a collective and prohibitive right, considering the power it grants to the owner: power to use, operate and act.

The principle is that the owner has all these powers and in particular on the right to act as the fundamental and prominent feature of ownership right and exceptionally the owner's powers can be limited by legal and other conventional restrictions.

This research paper is a study of the most important of these conventional restrictions: those on property, which limit the owner's power to act on money transferred to them by contract or will, and which are the condition of preventing them from acting on the content and the extent of its legitimacy - especially in the ence of a legal regulation in the civil law, compared with civil laws such as the French and Egyptian laws - as well as its scope and the validity of legal actions in violation of this condition and finally to explore its applications, particularly in real estate transactions, and in the framework of state-funded social housing.
