This research paper targets the crime of leaving the family's residence that stipulated under the Article 330 of the Algerian Penal Code, as being a crime on the family system, and considering the family bond as a main criterion in the field of criminalization.

Hence, leaving one of the parents to the family's residence and abandoning without a serious reason may harm the family security and stability.

The Algerian legislator protected the family from this crime due to its value in the society and the state, despite some defects noted.

Thus the legislator must rectify it via new formulation of the legal texts in a manner consistent with the privacy of the family, the structure of the society, And preserve the family cohesion and continuity.
