Abstract EN

This study deals with the Legal Characterization of the IP address, to know whether or not it constitutes personal data, which is difficult to resolve in the light of the definition of personal data given by the Algerian legislator in Law No .

18-07 of 10 July 2018 on the protection of natural persons with regard to the processing of personal data.

This difficulty in Characterization was also noted in the foreign judiciary, including the French judiciary, as well as the lack of explicit reference to the IP address in the definition of personal data, whether for the European law or the French law.

However, the situation witnessed a radical transformation starting in 2016 by adding the term 'online identifiers' , including the Internet Protocol address.

This is what was adopted by the French legislator according to Order No.

2018-1125 of December 12, 2018 issued in implementation of Article 32 of Law No.

2018-493 of June 20, 2018.

The Algerian legislature’s definition of personal data makes it difficult to say that an IP address is personal data.

In order to avoid ambiguity regarding the adaptation of the Internet Protocol address in Algeria, the Algerian legislator must amend the definition of personal data by adopting the definition of The EU general data protection regulation 2016/679, by adding an online identifier phrase, to resolve it as data of a personal nature.
