Abstract EN

The local government of Kurdistan Regional of Iraq and some Kurds believe and consider that (the disputed areas) is belong to the Kurdish people and the presence of non-Kurds people is an individual and random presence.

They believe that the presence of those people is mainly related with the existence of some of the social organizations which are modern and associated with the nationalism policies of Iraq's anti-Kurdish rulers who tried to change the demographic style of Kurdish land.

This belief intersects with the Cohesion of the social organizations (tribes and clans), whether Arab or Turkmen.

These clans are owned the land and inherited generation after generation.

Thus the connect of the distributed areas with kurdish's territory mean the abolition of all interests and natural rights, which are acquired from their presence on those land for many centuries.

this research has proved that the presence of tribal and clans (Arab and Turkmen) in the disputed areas is very old which is related to the centuries before the independence of Iraq in 1932.

Accordingly this presence is related to style of the tribes movement and without any directing from the Ottoman state.

The possession of these Arab and Turkmen tribes for the these land which is have known dimensions and borders and the imposition of sovereignty over hundreds of years.

In addition to the avowal of the state and other social components of this presence leaves a clear fact that this land, which is occupied by Turkmen and Arab social formations, were not only for the Kurds.

Therefore it is not justice and fairness to claim the Kurdish people the ownership of these distributed areas.

Also, The fact that these tribes and Arab and Turkmen tribes paid the taxes to the state gives a clear indication of the legality of them presence on those areas.

Thus, this oblige the state to protect them.

the most important thing is to protect them in the presence of their land and the land of their parents and grandparents and not uprooting them from their roots which is extended and related to All other Iraqi regions.
