The negotiating phase before the decade is of great importance, because it has been widespread in our societies, and it has abandoned some of the obligations that negotiators must abide by, so that the failure of the so-called civil liability, which is essentially the effect of compensation to the injured party, will result in compensation for the damage done to it.

In the ence of the Algerian legislator's provisions governing this stage, it was necessary to try to determine the legal nature of the responsibility resulting from the mistakes in it, where we find two basic positions for it, the first of which is considered a contract responsibility, and a position that links the legal nature of it to the existence of a negotiating contract or not.
