If both jurisprudence and the judiciary have agreed long time ago that there is no civil liability without damage occurrence, it is somewhat different for error, since we are encountering a long and, sometimes, a fierce debate about whether error is a component or an element of civil liability or it is not that necessary, thus, civil liability is established in isolation.

On this basis, this paper was based on the research paper in order to clarify the true status of the error and the stages in which it was once referred, starting from the stage of error dominance as a basis for civil responsibility, down to its decline and to identify the causes and factors that led to it
