Abstract EN

Enforcement of penalties is a major stage of criminal justice.

Practically, penal institutions are not without their social disadvantages and harm: convicts are prone to harm by mingling with criminals.

Such institutions weigh heavily on criminal justice system causing jurists and criminologists to focus attention on the introduction of new types of penal institutions and on diversification of penal treatment inside them in line with recent objectives of criminal penalties.

The main objective of this study is to highlight some observations on Federal Legislator's policy in handling conditional release in the Federal Law No.

(43) of 1992 As Amended.

Study used descriptive, analytical approach to analyze the UAE's legal attitude towards conditional release.

It further used comparative approach to review legal attitudes of other legal systems, and the deductive approach to highlight observations on Federal Legislator's policy regarding conditional release.

Major among the findings of the study was that in conditional release, convicts serve part of their custodial sentences in penal institutions, whereas the remaining term is served outside the prison under legal preconditions.

Study recommended inter alia: UAE Legislators' bridging the existing gap of imposing no obligations or restrictions on convicts while on parole, other than those imposed in the case where: the sentencing court is the court ordering the conditional release of a convict who is sentenced to life imprisonment and served 15 years of the jail term.
