Abstract EN

This Research tackles the civil liability for sports accident which occur by activity of the sports bodies such as leagues ,clubs and sports organizations .or which occur by the act of the participants in the sports activities such as athletes, referees, coaches, employees and volunteers , or which caused as a result of the fault of the races organizers , or the fault of the sport facilities directors , or which may be occur by the fault of sports equipment manufacturers .

Here by the research displays the bases of the civil liability for sports accidents ,the restrictions which have prevent establishing this liability, the effects of this liability and the agreements which may be enter on it, such as the exculpatory agreements, and sports liability insurance .

Through all that this research sheds the light on importance of existing counter balance between establishing this liability and the restrictions which have prevent it , And discloses the legislative and judicial attempts for finding this counterbalance and reveals defects of these attempts , This research accentuate the necessity of finding real and effective counterbalance between the bases of this liability and all its restrictions by wording real counterbalance not swinging counterbalance to concept of the voluntary and consent of the risks, and to concept of the obvious (or inherent) risk.

And following objectivity standard to apportion the sports liability on basis of the contributory negligence from the injured who often contributes by his negligence in occurrence of the sports accident ,even in precise situations which therein overlap injured negligence with liable negligence for sport accident , And this counterbalance can be made by the objectively dealing with exculpatory clauses from civil liability for sports accident ,and should not be extremeness in recognition of the legitimacy of these clauses without controls have suit with the nature of sports activity , As well as the insurance of sports liability plays a much more significant role in stabilization of the sports activity.

If this insurance depends on the existence of a balanced system of liability for sports accident ,it could play parallel role with this liability in supporting the sports activity.
