Abstract EN

The school-based violence criminal law prevents the use of physical or psychological abuse against teacher and student.

It prohibits many crimes like assault and battery, sexual abuses, slander and defamation.

We will focus on assault and battery and verbal violence.

The legal description applying to student’s actions when using violence against teacher is that of crimes of assault and battery leading to death or permanent disability, or that of unintentional or wrongful assault and battery.

However, the legal description applying to teacher’s violence against student is that ofassault and battery as provided for in article 408 of the Criminal Law, whereas the legal description applying to student’s slander of his teacher is that of insulting a civil servant as provided for in article 263 of the Criminal Law
