A commitment to safety is a commitment which is created by the French judiciary.

In the beginning he arranged this obligation on the carrier in the transport contract in a famous decision of the Civil Chamber of the French Court of Cassation on November 21st, 1911.

Then its application extended to various contracts, including the tourism and travel contract that is organized according to the Law (06/99) of April 4th, 1999 related to the organization of tourism and travel agencies.

This research tries to identify this obligation by clarifying its concept, its legal nature, its scope, and defining the basis on which it is based, from jurisprudence and comparative legislation point of view, especially In all of the Algerian, Egyptian, and French legislations.
