لقد قدمت المحاكم الجنائية الدولية الخاصة أنموذجا ليس الأحسن ولكنه الأرقي إذا ما قورن بمحاكم الحرب العالمية الثانية، لقد مكنت تجربة المحاكم الجنائية الدولية من إعطاء دفع قوي للقانون الدولي الجنائي عبر التأسيس للتقاضي على درجتين وهو ما يحقق وصف المحاكمة العادلة والسريعة لأنه يمكن المتهم من تجنب إمكانية الوقوع في الخطأ عبر الطعن في الأحكام الصادرة عن المحاكم الجنائية الدولية.
إن تجربة المحاكم الجنائية الدولية هي قرينة قاطعة على إمكانية قيام محكمة جنائية دولية تتوفر على كل المواصفات الشكلية والموضوعية لقريناتها في الأنظمة الجنائية الوطنية وهي لذلك مهدت لولادة المحكمة الجنائية الدولية، أكثر من ذلك برهان ساطع على الدور الفعال للعدالة الجنائية الدولية في تحقيق احترام الحقوق الإنسان.
Abstract EN
The ad hoc international criminal courts have presented a golden opportunity for the evolution of international criminal law.
the progressive jurisprudence of these courts has made a significant contribution to the fairness of the international criminal trial by guarantying the double jurisdiction which requires the right to appeal.
it ensures the correction of errors of law and fact of a previous decision.
these advances are proof of the slow but steady progress of international criminal justice towards the establishment of an effective and equitable international legal order where respect for human rights, at all times, is its main concern.
