The application of an alternative to good faith in English contract law

English contract law applies several standards or principles of equity and fairness to factual and legal issues arising from contracts instead of the general principle of good faith.

To establish equity, English law, uses well-tested schematic doctrines.

It has been widely accepted that these doctrines have developed alternative solutions in response to demonstrated problems of unfairness that equivalent or have more predictable application of the law compared to the application of a general doctrine of good faith in other legal systems.

Although, there is no standard of good faith in English contract law, it could be said that the applied doctrines have increased the tolerance towards the concept and its elements.

The following article discusses a number of these doctrines and equitable principles in more detail.

The focus will be on examining the doctrines of misrepresentation, duress, estoppel, implied terms, contract interpretation, and undue influence.
