Arabic Abstract

هدفت هذه الدراسة إلى الوقوف على مفهوم العمل اللائق وفقاً للاتفاقيات الدولية المعنية، و بيان مدى موائمة التشريعات العمادية للمعايير الدولية بهذا الخصوص و تحديد التعديلات التشريعية المطلوبة، و آلية تنفيذها حتى تفي السلطنة بالتزاماتها أمام المجتمع الدولي و ذلك من خلال تحديد الإطار الذي عديت به الاتفاقيات الدولية و التشريعات الوطنية ذات العلاقة خصوصاً أن برنامج العمل اللائق لم يلقى الاهتمام الكافي في كنف بعض القوانين الخاصة كقانون العمل العماني، إذ اعتمدت الدراسة على المنهج الوصفي التحليلي و قد توصلت إلى أن الضمادات التي كفلها المشرع العماني للعامل في قانون العمل يجب أن تنسحب على العمال المدرليين كون قانون العمل هو القانون الوحيد في سلطنة عمان الذي ينظم العمل و حقوق العامل في السلطنة ولا يوجد قانون خاص بتنظيم مهنة عمال المنازل، و تكمن أسباب وضع اتفاقية منظمة العمل رقم 189 بشأن العمل اللائق للعمال المنزليين في تطوير العمل المنزلي، فالعمل المدرلي لا يزال منتقص القيمة ومحجوباً، و من يمارسه معرض على وجه الخصوص للتميير فيما يتعلق بظروف الاستخدام و العمل و لغير ذلك من انتهاكات حقوق الإنسان.

و قد أوصت الدراسة بضرورة إقرار قانون خاص ينظم مهنة عمال المنازل و ينظم أحكامها و يضع مالهم من حقوق و ما عليهم من واجبات بشكل يؤدي إلى إقرار العمل اللائق لهم على ضوء اتفاقيات منظمة العمل الدولية و اتفاقية العمل اللائق رقم 189 بشكل خاص، و ضروره الانضمام إلى لهذه الاتفاقية حيث تعتبر ضمانة لفئة عمال المدارل المتواجدين في سلطنة عمان.

English Abstract

This study aimed to identify the concept of decent work in accordance with the relevant international agreements, to demonstrate the relevance and compliance of Omani legislation with international standards in this regard, to identify the required legislative amendments, and the mechanism for their implementation so that the Sultanate fulfills its obligations before the international community by defining the framework by which international conventions and national legislation are concerned.

Relevant, especially since the decent work program did not receive sufficient attention within some special laws, such as the Omani Labor Law, as the study relied on the descriptive and analytical approach, and the comparative approach.

It concluded that the guarantees guaranteed by the Omani legislator to the worker in the labor law apply to domestic workers since the labor law is the only law in the Sultanate of Oman that regulates work and workers' rights in the Sultanate, and there is no special law regulating the profession of domestic workers, and the reasons for establishing Labor Organization Convention 189regarding work Decent work for domestic workers in the development of domestic work, as domestic work is still devalued and hidden, and those who practice it are particularly vulnerable to discrimination regarding conditions of employment and work, and other human rights violations.

The study recommended that a section on collective labor disputes should be singled out in the Omani Labor Law, which is of a degree of importance, so that it takes into account the speed in the body and the reduction in time and expenses and achieves stability and stability for all parties to the conflict in resolving it, and therefore the legislator should regulate it in the Labor Law.
