The UNIDROIT Principles recognize open terms in contract being "agreement to agree", whether they relate to an essential term or not as well as leaving a term to be determined later by a third person.

The Principles recognize also silence on one term or more.

In all these presumptions, the contract remains valid, implied terms applied.

According to Qatari Law, only non-essential terms can be agreed upon later.

The Qatari Civil Code recognizes two applications of silence on an essential term, exceptionally the contract remains valid and a default rule applies, and those are the lease amount and the contractor's remuneration.

Unlike the Civil Code, the Commercial Code accepts silence on the price in a sale contract, here, the market price applies.

The same applies if the third person fails to determine the price in a commercial sale.
