The idea of compensation for the injured is an old idea that societies have known since its inception and organized by their legal rules in order to reduce harm to the victim and to punish the actor.

In turn, international law used this idea and applied it as a result of international responsibility.

Opinions on the issue of compensation have been directed in the first two parts, which it considers to be of a reformist nature, while the second trend calls for a punitive nature to deal with the damage.

The international judiciary has recently recognized the idea of compensation for victims, which considered to be complementary to the processes of international judicial justice due to widespread violations of the rules of international humanitarian law.

When the International Criminal Court was established, the idea of compensating victims of crimes was one of the most important provisions of its Statute.

They are harmed by acts of war and aggression, which they have affirmed to be one of the types in which the rules of international law have been subject to compensation in kind and financial and moral compensation, and for that purpose a trust fund has been established for this purpose.

In order to take into consideration the subject matter of importance, we decided to divide it into two main topics.

The first is the concept of compensation, its nature and the opinions on which it was said in international law, while the second is related to the formation of the International Criminal Court and the issue of compensation in its statute.
