كرس المشرع الجزائري من خلال دستور 2016 و القانون 18/02 الوظيفة الاستشارية لمجلس الدولة و حصرها في إبداء الرأي حول مشاريع القوانين و أوامر رئيس الجمهورية في الظروف العادية، مستبعدا من ذلك أوامر رئيس الجمهورية في الظروف الاستثنائية، و اقتراح القوانين و كذا المجال التنظيمي للسلطة التنفيذية و التشريعية.
عكس المشرع الفرنسي الذي وسع من مجال الوظيفة الاستشارية لمجلس الدولة، حيث يشمل مشاريع القوانين و الأوامر و اقتراح القوانين و المجال التنظيمي.
Abstract EN
Through the Constitution of 2016 and Law 18/02, the Algerian legislator devoted the consultative function to the State Council and limited it to expressing opinions on draft laws and orders of the President of the Republic in normal circumstances, excluding from the orders of the President of the Republic in exceptional circumstances, proposing laws as well as the organizational area of the executive and legislative authority.
The French legislator reflected the expansion of the advisory function of the Council of State, which includes draft laws and orders, proposing laws and the regulatory field.

Le législateur algérien a consacré, par la Constitution de 2016 et la loi 02/18, la fonction consultative du Conseil d'Etat, la limitant à l'émission d'avis sur les projets de lois et les ordonnances du Président de la République dans des circonstances ordinaires, la préparation des ordonnances du Président de la République dans des circonstances exceptionnelles, ainsi que la sphère organisationnelle du pouvoir exécutif et législatif.
Contrairement au législateur français, qui a élargi le champ de la fonction consultative du Conseil d'État aux projets de lois, aux arrêtés, aux propositions de lois et à la sphère réglementaire.
