يعتبر التحكيم من أهم الوسائل التي يتم اللجوء إليها لحل النزاعات التي تنشا عن عقود نقل التكنولوجيا، و هذا لما يتميز به التحكيم من بساطة الإجراءات سرعة البت في النزاع و سهولة تنفيذ الحكم التحكيمي دوليا، أحاول في هذا البحث بيان القانون الواجب التطبيق على موضوع النزاع في عقود نقل التكنولوجيا و ذلك ببيان دور الأطراف في اختيار القانون واجب التطبيق في المبحث أول و تحديد دور هيئة التحكيم في اختيار القانون واجب التطبيق في حال غياب قانون الإرادة أو استبعاده في المبحث الثاني.
Abstract EN
Arbitration is one of the most important means that is used to resolve disputes arising from Technology transfer contracts, and this is characterized by the simplicity of theproucedures, the speed of settlement of dispute and the ease of implementing the arbitral award internationally.
In this research, I try to explain the law applicable to the supject matter of the dispute in transfer contracts Technology by clarifying the role of the parties in choosing the applicable law in the first topic and defining the role of the arbitral tribunal in choosing the applicable law in the absence of the law of will or its exclusion in the second topic.

L’arbitrage est l’un des moyens les plus importants utilisés pour résoudre les différends découlant des contrats de transfert de technologie, et cela se caractérise par la simplicité des procédures, la rapidité de règlement du différend et la facilité d’exécution de la sentence arbitrale au niveau international.
Cette étude vise à clarifier le rôle des parties dans le choix de la loi applicable au fonds des litiges relatifs aux contrats de transfert de technologie, et le rôle du tribunal arbitral en l’absence du choix de cette loi par les parties ou dans le cas de l’exclusion de cette dernière.
