Transitional justice intermarries judicial and non-judicial mechanisms in pursuit of goals, most notably the achievement of reconciliation, peace and the rule of law, all in accordance with the requirements of international law.

Amnesty measures is one of the most prominent mechanisms for achieving national reconciliation.

If transitional justice is concerned with investigating and holding accountable for grave violations of human rights, pardon measures may prevent this, which is inconsistent with the state's obligations to administer justice, and therefore pardon measures may be considered contrary to international law if they include amnesty on grave violations of human rights.
