Abstract EN

Scholars have left through history foundational principles for doctrinal principles; a science that gathers jurisprudence’s remnants and takes hold on its innumerable details and branches.

It is considered one of the most important research areas related to Fatwa (opinion based on jurisprudence) in particular.

The latter changes over time, place and circumstances as it also differs depending on the foundational principles it is based on; amongst these principles are doctrinal principles on which Fatwa is relatively dependant.

Therefore, a scholar needs proofs from Quran and Sunna besides to knowing the legitimate purposes relevant to people’s circumstances and macro doctrinal principle.

On these bases, the principles have taken the course of reasoning.

However, the difference in Fatwa is due to the origin of doctrinal principle that is subject to legitimate and mental origins, viz, a cause of doctrinal disagreement in its parts.
