Abstract EN

This study aims to shed light on the effects of searching a suspect’s house by the judicial officer in flagrante delicto to seize evidence to reveal the facts of the crime in accordance with objective and formal controls of searching as stipulated by the law.

If the judicial officer executes the legal seizure without consideration to such controls, he/she shall be subjected to a procedural sanction, i.e.

revoking the undertaken procedure by the judicial officer and bearing the criminal, disciplinary and civil liability.
