Abstract EN

This research contents a brief explanation about the method of Sadd Al Dharia', while showing its importance in the Islamic jurisprudence, as it has effected the Islamic jurisprudence and how much it involve in constructing each legitimate strings of legal opinions.

This research is an attempt to explain the views of the scholars on Sadd Al Dharia’ between those accepting it and those against it, and those who implemented it a lot and those who don’t.

And to conclude at the end the reason of the contradiction of views between the scholars around this great method in Islamic jurisprudence, and it’s clear that from showing the views of scholars and by looking on the branches of the jurisprudence that appeared according to this great method, the Imams of the four schools agreed to accept the legislation of this method in general, unless they differs in the branches of the jurisprudence which were build under this method.

In contrast of those depend on it a lot bringing lots of examples from the method, like the scholars from the Maliki and Hanbali schools, and those using it less avoiding from using in a lot of circumstances, and very careful in implementing it such as scholars from Shafi’i and Hanafi schools.
