Mobile phones play a central role in the lives of individuals because of their intelligent characteristics that bring them closer to the ranks of personal computers, so that there was a need for criminal protection for the owner of the mobile phone in the face of law enforcement authorities to provide some degree of guarantees the mobile phone must be closely related to the person of the suspect and must be the satisfaction of the phone previously to search its contents by the police man as well as the availability of the case, allowing the police man to search the mobile phone contents in order to find the criminal evidence, the study concluded that the constitutional protection contained in article 39 of the Kuwaiti constitution and the fourth amendment of the U.S.

constitution required the presence of judicial authorization before searching the mobile phone, that the criterion for the precise identification of mobile phone search warrants is very well direction of the U.S.
