Abstract EN

This research studies two articles of the Tunisian Personal Status Law; article (9) on the issue of guardianship, and article (18) on the issue of polygamy.

It aims to explain the extent to which the provisions of these two articles contravene Islamic jurisprudence.

It also aims to explain the importance of adopting Islamic Sharia as a basic reference for the law.

One of the most important results of the research is that the Tunisian legislator has several Sharia violations in family rulings, such as abrogation of the meaning of guardianship in article (9), and his criminalization of polygamy at all without restriction or exception in article 18
