Antiquities are considered public property, so it is required that they enjoy adequate criminal protection and that protection be at the level that guarantees non-aggression against antiquities, as antiquities are considered cultural and historical heritage.

They must be preserved from loss, tampering, theft and smuggling .

The crime of excavating antiquities without approval is one of the antiquities crimes that represent an attack on antiquities.

Therefore, the Iraqi legislator has criminalized this behavior in Article (42) of the Antiquities and Heritage Law No.
