The importance of the research topic (tort liability arising from the contract) comes through dealing with an important topic of civil liability, which is an attempt to break the deadlock created by the jurisprudence between the two types of civil liability and to indicate the extent to which one of them has been achieved within the scope of application of the other.

Moreover, in many cases, the contractor has a desire to choose the two liability rules, because one of them can make reparation for damage according to a greater amount of the other liability rules.

To clarify the foregoing, the research was divided into two sections: The first dealt with civil liability arising from a criminal error, fraud, or serious error, while the second study dealt with some of the applications of tort arising from the contract.
