Abstract EN

This paper analyzes the topic of Property-Security, under the reforms of French security law until May 2021, with the aim of determining the extent of its effectiveness in strengthening the status of the creditor, after the crisis of Security Rights following the change of philosophy of insolvency law towards the safeguarding of companies and the protection of workers' rights.

The study concludes that the Property-Security returned today to crown the queen of securities, because of the simplicity it offers to the parties for the creation and realization, as well as its effectiveness in collective procedures, because it grants the creditor the right of exclusivity on the assets of the guarantor and allows the debtor to have an optimal financing tool without restricting his use of the assets.
