Abstract EN

This research aims to examine the subject of electronic auction as an important and modern legal act of electronic commerce.

After highlighting its concept, its legal nature as well as its basic elements, it has been shown to be unique to a self-contained system that is not subject to the provisions of the law of electronic commerce.

Despite the importance of this type of sale and the prevalence of its use through the electronic media, Algerian legislation has not yet sought to establish the necessary legal controls.

Therefore, in order to legitimize such commercial transactions, our legislator must expedite the filling of this legislative vacuum by creating its own mobile legal system through which to define its various provisions.
