Abstract EN

This study aims to determine how the emergency administrative judge interferes in the local public service delegation and the purpose of this intervention in the case of violations of competition procedures and publicity before the conclusion of such contracts, they fall within the category of administrative contracts, in accordance with executive decree no; 18/199 on the delegation of the local public service and the code of administrative and civil procedures 08/09.

The latter is known to intervene only under conditions such as the fact that a case must be brought before the administrative court and be brought within the time limits set, which give rise to great uncertainty.

And about of used curricula, we have been guided by the descriptive method to the description of the legal articles relating to this subject and the analytical method to their analysis.

Most importantly, its involvement in the delegation of the local public service is considered to be very important in correcting its flawed beginning, on which the various subsequent stages, particularly the implementation phase, and it's very important in protecting public finances and fighting administrative and financial corruption
