The penal legislator maintains in the general rules of the moral pillar a set of principles and principles, and perhaps the most important of these principles is the principle of “no crime without error.

However, by returning to the texts related to customs crimes, we find that the legislation did not address the moral element of customs crimes except to the extent that it was not stipulated that they are - customs crimes - material crimes as a general rule.

Hence, this study comes to examine the extent to which there is a moral element in customs crimes or not.
