شكل تفشي وباء فيروس كورونا (كوفيد-19) تهديدا خطيرا للمجتمع الدولي و أثر على جميع القطاعات تقريبا.
على الصعيد العالمي، لا يمكن مكافحة تفشي الوباء أو القضاء عليه من قبل دولة واحدة، و بالتالي، فإن التنسيق بين جميع الدول أمر بالغ الأهمية.
في نطاق إدارة الصحة العالمية، تعد منظمة الصحة العالمية "السلطة التوجيهية و التنسيقية بشأن العمل الصحي الدولي"، و هي مكلفة على وجه الخصوص بتحفيز العمل على استئصال المرض و دفع الوباء.
و تحقيقا لهذه الغاية، يتناول هذا المقال، من خلال دراسة متعمقة، تأثير تفشي فيروس كوفيد 19 على كفاءة منظمة الصحة العالمية في الاضطلاع بمهامها المنوطة بها، على النحو المنصوص عليه في أطرها القانونية خلال أوقات الطوارئ الدولية.
و يعالج المقال هذا الموضوع من جانبين : الأول : كيفية صنع القرار داخليا داخل منظمة الصحة العالمية للسيطرة على تفشي كوفيد 19، و الثاني : كيفية تفاعل المنظمة مع الدول لضمان الامتثال للقوانين و التوصيات ذات الصلة.
و على ذلك، تنقسم هذه المقالة إلى أربعة أجزاء، يتناول الجزء الأول منزلة منظمة الصحة العالمية باعتبارها الفاعل الرئيسي في نظام الحوكمة الصحية العالمية، مع إبراز سلطاتها و مسؤولياتها الرئيسية في أوقات الطوارئ الدولية.
و يفحص الجزء الثاني الأدوات و السلطات و الآليات القانونية لمنظمة الصحة العالمية لمكافحة الأمراض و ما إذا كانت مناسبة و موثوقة.
و يركز الجزء الثالث على استجابة منظمة الصحة العالمية لتفشي وباء كوفيد 19 في ضوء ولايتها و سلطاتها على النحو المنصوص عليه في اللوائح الصحية الدولية لعام 2005.
و يختتم الجزء الرابع بتقييم فاعلية استجابة منظمة الصحة العالمية للأزمة المستمرة و سبل تعزيزها.
و تختتم هذه المقالة باقتراح ثلاثة مبادئ لتحسين استجابة منظمة الصحة العالمية لتفشي الأوبئة، و هي : تطوير آلية شفافة لإدارة جميع الأعمال داخل منظمة الصحة العالمية، و لا سيما صنع القرار، و وضع آلية إنفاذ لفرض الامتثال على الدول الأعضاء، و تطبيق نظام صارم لمساعدة الدول في بناء قدراتها.
Abstract EN
The outbreak of Coronavirus (Covid-19) pandemic has posed a serious threat to the international community and has impacted almost all sectors.
Globally, pandemic outbreaks couldn’t be fought or eradicated by one state; hence, the coordination between all states is crucial.
Within the ambit of Global Health Governance, the World Health Organization, is ‘the directing and coordinating authority on international health work’.
It is mandated, particularly, to stimulate and advance work to eradicate disease.
To this end, this article examines, through an in-depthcase study, the impact of the ongoing Covid-19 outbreak on the efficiency of the WHO to undertake its mandate during times of emergencies, as prescribed in its legal frameworks.
The article addresses this issue from two sides: how the decision-making process has been taken internally within the WHO to control the global outbreak of the Covid-19, and how the WHO interacted with states to ensure compliance with relevant laws and recommendations.
In doing so, this article is divided into four parts.
In part I, it introduces the WHO as the main actor in the global health governance, highlighting its main powers and responsibilities.
Part II examines the WHO’s legal tools, powers and mechanisms to control diseases and discusses whether these are fit and reliable.
Part III focuses on the WHO response to the ongoing outbreak of Covid-19 in light of its mandate and powers as provided in the 2005 International Health Regulations.
Part IV concludes on the effectiveness of the WHO response to the ongoing crisis and suggests relevant ways for enhancement.
