The marine insurance contract is among the oldest fields of insurance, it prosper through the different transactions of the maritime navigation movement, which led to the development of maritime transport economics; resulting from it many disputes; and order to settle it, it was necessary to find non- judicial mechanisms to implement the maritime transport contract with friendly ways, or by arbitration contract.

on the other hand; it is possible to settle it by finding judicial mechanisms represented in the loss and abandonment lawsuit.

the first is the regular way to claim insurance compersation which is the original where the insured may use it in all risks whatever their importance; as for the abandonment lawsuit; it is a purely exceptional rod for marine law; this is because it includes its own systems which are represented in the system of contributing to joint losses and the abandonment system.
