The subject of the study is the legal status of the constitutional oath, a comparative study between the Algerian constitutional system and comparative constitutional systems, based on the problem of: Does the constitutional oath occupy the same position in the Algerian constitutional system as it enjoys in the comparative constitutional systems? And a comparison of the legal provisions related to the constitutional oath in all Algerian constitutions, starting from the constitution of 1963 to the constitutional amendment of 2016, and various other constitutions that were chosen based on the importance of the legal provisions therein.

This study concludes that the legal position of the constitutional oath in the Algerian constitutional system is of medium importance compared to its place in the constitutions of other countries, which gave it great importance and detailed the provisions related to it and the implications for it.
