The review of the constitutionality of laws is one of the most important elements of the State of law, and this is why it has been enshrined in global constitutions such as the Algerian constitution, which has brought them under the jurisdiction of the Constitutional Council for a long time until the 2020 amendment, which created a constitutional court that oversees the constitutionality of laws, as it is a judicial review.

However, the Algerian constitutional founder did not categorically rule on the judicial nature of this court as it has retained certain characteristics of the Constitutional Council in terms of membership and notification points, and on the other hand, naming it as court indicates that it is a judicial court
