One of the most important reasons for acquiring property is death which succession is achieved in money.

therefore, Islamic shari'ah took over the formulation of the rules oh inheritance in precise manner and limits its limits in turn the Algerian legislator embraced it.

Although a person is free to dispose his property during his life, it's bounds by legal controls in order not to prejudice the right of the heir who has the right to cling to his third party towards the inheritor's dispose in his property, even though he is originally a legal successor.

and between these two considerations arises the issue of the third party.
