Public rental housing is primarily intended for rent as a public asset, and the lease contract is classified among the contracts that focus on the use of something only.

Thus, housing, the subject of the formula, is specified for rent and not for ownership; it is, therefore, inalienable.

In addition, it is illegally prohibited for a tenant of public rental housing to waive the right to rent for the benefit of others from the categories stipulated in the law, given that his or her house obtaining was motivated by an urgent need for it.

However, the public authorities may assign ownership of these houses for the benefit of their occupants on an exceptional basis, which is executed through a legal provision.
