ظلت مشكلات تأثير الأوبئة على الالتزامات التعاقدية مصدر كثير من القلق على مر العصور وعدم الاستقرار للمراكز القانونية المتباينة، ولكن أكثرها قلقا هو تأثير فيروس كورونا المستجد على آثار العقود الزمنية بشكل عام وعلى عقد الإيجار والإيجار التجاري بشكل خاص، هذا وقد أثرت الحالة الاقتصادية في إعسار العديد من الأفراد والشخصيات الاعتبارية، مما ألقى بظلاله على العلاقة في حصول عدم التوازن فيما بين ما يحصل عليه المالك من أجرة وبين ما يحصل عليه المستأجر من منفعة في مقابلها.
فيتناول موضوع هذا البحث تحديد أثر الأوبئة على العقود الزمنية الملزمة للجانبين تطبيقا لنظرية القوة القاهرة وفقا للقانون الكويتي والمقارن ويقدم هذا البحث دراسة تحليلية مقارنة عن طريق سرد للقواعد العامة للقوة القاهرة على جائحة كورونا، وكذلك تسليط الضوء على بعض نصوص القوانين العربية والأجنبية، ومنها القانون المدني الفرنسي بما تضمنه من أحكام جديدة، وتوصلنا في نهاية البحث إلى عدة نتائج أهمها تقييم وتحديد مدى اعتبار جائحة كورونا قوة قاهرة، وقدمنا بعض الاقتراحات أهمها تعيين جهة مستقلة تتولى الفصل في المنازعات الناجمة عن جائحة كورونا وكذلك بعض المقترحات التشريعية كإضافة نصوص تشريعية واضحة لمفهوم القوة القاهرة وشروط تحققها، أسوة ببعض التشريعات العربية كما في المغرب أو على النحو الذي استحدثه القانون الفرنسي في عام 2016.
Abstract EN
The problems of the impact of epidemics on contractual obligations have been a source of much concern over the ages and instability of disparate legal centers, but the most worrisome is the impact of the new corona virus on the effects of time contracts in general and on the lease and commercial lease contract in particular, and this has affected the economic situation in the insolvency of many of individuals and legal persons, which cast a shadow over the relationship in the occurrence of an imbalance between what the owner receives from the rent and the benefit the lessee gets in return.
the topic of this study deals with determining the impact of epidemics on the labor law that is binding on both sides.
at the end of the research, we reached some results, the most important of which is the assessment and determination of the extent to which the pandemic is considered coercive, and we made some suggestions, the most important of which is the appointment of an independent body to adjudicate issues related to the new separation apparatus.
