State private property tourism is one of the types of investment-oriented property, it is the bedrock of all investment projects and its effective role in advancing economic and social growth, the legislator has stated that the success of the investment policy in Algeria is based on the guidelines for the design of tourism, it includes a series of regulations and procedures through which states aim to promote tourism through the development of plans and programmes, the various aspects of Algeria s presentation are optimized.

Studies have shown that the Algerian legislator has adopted the system of concession by non-derogable consent as a mechanism for the exploitation of the tourist property belonging to the private property of the state, with a view to preserving and valuing the state estate portfolio.
