بالرغم من استقرار البناء التقليدي لمسؤولية الإدارة على الفعل الضار لأعوانها، إلا أن تزايد النصوص القانونية التي تلزمها بالتعويض عن أضرار لم تكن سببا في وقوعها قد أدى لبروز تساؤل عن مدى إمكانية اعتبار "القانون" كأساس مستحدث للمسؤولية الإدارية.
هدفنا من خلال هذه الدراسة للإجابة على هذه الإشكالية من خلال بحث أصل وخلفيات إلزام القانون للإدارة العامة بإصلاح أضرار أجنبية عن نشاطها، ومن خلال استقصاء تطبيقات ممكنة في التشريع الجزائري لمثل هذا الإلزام بما يثبت التجسيد غير العرضي للقانون" كأساس للمسؤولية الإدارية.
خلصنا في دراستنا إلى أن القانون يصلح أن يكون أساسا مباشرا يقيم مسؤولية الإدارة بتعويض أضرار لم تحدثها بناء على الدور الاجتماعي للدولة، مع الإشارة للقلق المتأتي عن كثرة النصوص المقيمة لمثل هذه المسؤولية وإطلاق صياغتها أحيانا بما من شأنه إثقال كاهل الخزينة العمومية مستقبلا.
Abstract EN
Despite the stability of the traditional structure of the administration’s responsibility on the harmful act of its agents, the increase in legal texts requiring the administration to compensate for damages that it did not cause has led to the question of the extent to which "law" can be considered as an innovative basis for administrative responsibility.
this study aims to discuss this question by examining the origin and background of the law’s obligation for the public administration to repair damages foreign to its activities, and by investigating possible applications in the Algerian legislation for such obligation to prove the non-accidental embodiment of the “law” as a basis for administrative responsibility.
