Abstract EN

This research discusses the judgment of benefiting by the common part of a lease.

It is divided into four chapters.

In the first chapter I defined the common ownership and showed the right of the partner in the common wealth and the source of its circulation In the second chapter I defined the lease and showed its legality.

While the third chapter includes the scholars' creeds concerning letting a partner's share to a foreigner without partners' agreement, and showed the scholars ways and their evidences and what controversies it takes and showed the best of them.

In the fourth chapter I discussed the partner's renting the whole common wealth without partner's agreement and its consequences.

Then, I concluded with important findings.
