تعتبر الملكية العقارية أهم وجهة تم استغلالها في مجال الاستثمار وفق منظومة تشريعية معقدة ومتناثرة ومتعددة ضمن تعديلات لا نهاية لها في توجيه الأوعية العقارية للاستثمار ضمن ما يعرف بالعقار الاستثماري الذي ينظر إليه من جانب العقار نفسه محل الاستثمار الصناعي أو السياحي أو الفلاحي أو الوقفي أو حضيرة تكنولوجية، الذي تم تنظيمه من خلال الأمر 08-04 المؤرخ في 01 / 09 / 2008 المحدد لشروط وكيفيات منح الامتياز على الأراضي التابعة للأملاك الخاصة للدولة والموجهة لإنجاز مشاريع استثمارية المعدل والمتمم، ومن جهة الملكية العقاري باعتبارها حق عيني ضمن نوعية طرق الاستغلال للعقار في مجال الاستثمار ضمن عقد الامتياز العقاري الذي اختلف طرقه بين التراضي والتنازل، ونظرا لعدم استقرار المنظومة التشريعية في مجال العقاري الاستثماري نظرا للتعديلات المتلاحقة في قوانين المالية أدى إلى عدم تشجيع الاستثمار في هذا المجال وفشل المشاريع الاستثمارية نظر لعدم تحقيق الأمن القانوني في مجال العقار الاستثماري.
English Abstract
Real estate is regarded as the most important development destination in the field of investment.
its legislative system is complex, scattered and diverse.
the main body of real estate investment is located in the so-called real estate according to the conditions and conditions stipulated in decree no.
08-04 of September 1, 2008, real estate itself is regarded as an alternative investment to industrial, tourism, agriculture, car parks or technological car parks.
the quality of the real estate development mode is to grant the concession on the state private land to complete the modified and supplemented investment projects, and to incorporate the real estate ownership as a physical right into the field of land use right the way of investment within the scope of real estate concession contract is different between consent and abandonment.
moreover, due to the continuous amendment of financial law, the legislative system of real estate investment is unstable, which leads to the instability of the system due to the lack of legal protection in the field of real estate investment, the investment in the field of real estate investment is not smooth and the investment projects fail.
