Arabic Abstract

يشكل القضاء أهم مرفق من المرافق العمومية التي تحظى بالاهتمام، ذلك أن دور القضاء لم يعد ينحصر في فض النزاعات بين الطرفين، بل أصبح يلعب دورا مهما في تحقيق التنمية الشاملة، وترسيخ دولة الحق والقانون، وهذا من خلال توفيره مناخ الثقة للمستثمرين، كما أنه لا يمكن للقضاء أن يحقق هذا الدور البارز والهام من دون توفر الأمن القانوني والقضائي معا، هذا الأخير الذي أصبح يشكل المناخ المناسب للاستقطاب وتشجيع الاستثمار، ومن ثم تحقيق التنمية الشاملة والمطلوبة ومن أهداف موضوع الأمن القضائي هو التحفيز على الاستثمار والمساهمة في خلق النشاطات الاقتصادية بغرض تحقيق بيئة أمنية تدفع وتشجع المستثمر لدفع عجلة الاستثمار وطنيا، في ظل سيادة القانون واستقلال القضاء، أيا كانت جنسية المستثمر، إذ لا استثمار بدون ضمانات قضائية واضحة.

ومن النتائج المتوصل إليها هو أن تحقيق التنمية رهين بمدى نجاعة المنظومة القضائية وكذا فعاليتها ونزاهتها واستقلاليتها، وقدرتها على ضمان تكافؤ الفرص والمساواة وكفالة الحقوق والحريات.

English Abstract

The court is one of the most important public facilities that deserve attention since its role is not limited only to settling conflicts, but contributes to the achievement of a comprehensive development and establishing justice through creating an atmosphere of confidence for the investors.

furthermore, the court cannot play this role without the judicial and legal security.

it creates the suitable atmosphere that attracts investors and thus, creates the needed comprehensive development.

among the objectives of judicial security is the motivation to invest an to create economic activities that establish a safe environment that encourages the investor.

and boosts national economic development in the light of justice regardless the nationality of the investor.

findings show that achieving development is the outcome of the success of the judicial system, its efficacy, integrity, independence, and ability to guarantee equal opportunities, rights, and liberties.
