Abstract EN

The research aims at determining the extent to which the Palestinian legislators provided the Constitutional Court with the rules to settle the ineligibility challenge against the President.

The researcher concluded that the Palestinian legislations have no rules determining the eligibility scope, competent plaintiff, and procedures to file and settle the challenge, except the rule stipulating two third majority of the legislative council to ratify the court's decision of ineligibility against the President.

Applying the general rules could raise problems.

Thus, the research presents recommendations to avoid such lacuna including empowering the Legislative Council to file the challenge before the court.
